Personal and business information privacy is extremely important to Authentic Restaurant Concepts Inc.  (dba The Restaurant Boss) (“ARC,” “we,” “our,” “us”, “Company”).  We have prepared this Privacy Policy to explain how we collect, use, protect, and disclose Personal and Business Information, Business Data and Usage Data (each as defined below) that you share with us when you use https://therestaurantboss.com, https://scalemyrestaurant.com, https://clickbacon.com  (the “Web Site”), our software products and other ARC services (collectively, the “Products and Services”).  This Privacy Policy also explains your choices for managing Personal and Business Information preferences, including opting out of certain uses of your Personal and Business Information.  This Privacy Policy applies to all users of the Web Site and our Products and Services.

BY USING THE WEB SITE AND/OR OUR PRODUCTS AND SERVICES, YOU ARE CONSENTING TO THIS PRIVACY POLICY.  PLEASE READ THE ENTIRE PRIVACY POLICY AND ALSO OUR TERMS OF SERVICE CAREFULLY. Your consent may be withdrawn at any time and we will no longer provide the Services for which you have registered.

 

MANAGING YOUR PERSONAL AND BUSINESS INFORMATION PREFERENCES

You can review, correct, update, or change your Personal and Business Information or opt out of receiving certain e-mails by changing the relevant settings in your account on our Web Site or by emailing us at [email protected].  You can erase all Personal and Business Information and Business Data from the Products and Services by deleting all of the stored information; however, some or all of Personal and Business Information and Business Data may exist in regularly scheduled backups and you must email us at [email protected] and request for the deletion of all of Personal and Business Information and Business Data.  You are able to opt out of receiving marketing emails from us; however, you cannot opt-out of receiving emails related to the status or maintenance of your account. DATA RETENTION PERIOD

We will retain your Personal and Business Information, Usage Data or Business Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.

CHILDREN’S PRIVACY

We do not knowingly collect personally identifiable information from anyone under the age of 18. 

If you are under 18, do not use or provide any information on this Website or on or through any of its features/register on the Website, make any purchases through the Website, use any of the interactive or public comment features of this Website or provide any information about yourself to us including your name, address, telephone, email address or any screen name or user name you may use.  

If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 18, please contact us at [email protected].

INFORMATION COLLECTION

Creating an Account – Personal and Business Information

We collect information that personally identifies you and your business, such as your name, business information, address, phone number, mobile phone number, email addresses, payment and financial information, gender, and other identifiable information, that you choose to provide us with or that you choose to include in your account information (“Personal and Business Information”).  You will be asked to provide us with information when you register with the Web Site and create an account, or use any of our Products and Services, and at other times.  We may also receive Personal and Business Information, including your username, social network ID, and posts that you have shared, from social media websites and services (e.g., Facebook, Twitter, Instagram, Pinterest, LinkedIn and Google+) if you choose to enable those features.  We use this information to help us understand how people use the Web Site and our Products and Services, and to enhance the products and services we offer.

Business Data

When you use our Web Site and Products and Services, we may automatically collect certain business-related information from you (“Business Data”).  For example, when you use the Products and Services, we may automatically collect, among other things, the types of goods you purchase, sales and operational information, and the frequency of your sales.  We use this information to help us better understand and analyze our customer demographic and to enhance the products and services we offer.

Usage Data and Site Activity

We automatically collect information regarding your usage of and activity on the Web Site and our Products and Services (“Usage Data”).  For example, each time you use the Web Site and our Products and Services we automatically collect the type of Web browser you use, your operating system, your Internet Service Provider, your IP address, the pages you view, and the time and duration of your visits to the Web Site and use of our Products and Services.  We use this information to help us understand how people use the Web Site and our Products and Services, and to enhance the products and services we offer.  

Surveys

From time to time, we may administer surveys.  Personal and Business Information is obtained from you when you respond to web surveys. We may use this Personal and Business Information to provide you with information and services for which you have expressed an interest or that you may find useful based on your answers in a survey. We might also send out emails to users to announce special offers, services and announcements from our Web Site and/or third-party advertisers. Additionally, we may refer to your Personal and Business Information to better understand your needs and how we can improve our Web Site and the Products and Services we offer.  Those offers may contain affiliate links in which we may get a commission at no extra cost to you.  None of the fees associated with those purchases have been increased to compensate us.  We do not sell any of your personal or business information to third parties.

Newsletters

Personal and Business Information is obtained from you when you request to subscribe to a newsletter.  We may use this personally identifiable information to deliver the newsletters that you have elected to receive.  We might also send out e-mails to announce special offers, services and announcements from our Web Site and/or third party advertisers, or other information responsive to the data you provide us.  Additionally, we may refer to your Personal and Business Information to better understand your needs and how we can improve our Websites and our Products and Services.

Cookies and Anonymous Identifiers

At times, we use cookies or other anonymous identifiers.  Some of our Service Providers (defined below) may also use their own cookies, anonymous identifiers, or other tracking technology in connection with the services they perform on our behalf.

HOW WE USE, DISCLOSE AND SHARE INFORMATION AND DATA

We do not share or sell your Personal and Business Information, Usage Data or Business Data unless it is de-identified.  We use your Personal and Business Information, Usage Data or Business Data to provide you with the Web Site and our Products and Services, to better understand and analyze our customer demographic, to send you alerts about your account, to send marketing communications to you, to improve the Web Site and our Products and Services, to notify you of new products or services, and to otherwise communicate with you. 

We send a weekly newsletter, occasionally specific marketing messages, and reminders for events that a user has registered for.

In certain circumstances including but not limited to SMS messages, “message and data rates may apply”.

Reply “STOP” to any SMS message to be removed from future SMS messages.

 

DATA THAT DOES NOT IDENTIFY YOU (DE-IDENTIFIED DATA)

We may share or sell aggregated, de-identified data that does not identify you, with partners and the public in a variety of ways, such as by providing research or reports about industry and business.  When we provide this information, we perform appropriate procedures so that the data does not identify you and we contractually prohibit recipients of the data from re-identifying it back to you.

SERVICE PROVIDERS

From time to time, we may establish a business relationship with other businesses whom we believe are trustworthy and who have confirmed that their privacy practices are consistent with ours (“Service Providers”).  For example, we may contract with Service Providers to provide certain services, such as hosting and maintenance, data storage and management, payment processing, and marketing and promotions.  We only provide our Service Providers with the information necessary for them to perform these services on our behalf. Each Service Provider must agree to use reasonable security procedures and practices, appropriate to the nature of the information involved, in order to protect your Personal and Business Information, Usage Data and Business Data from unauthorized access, use, or disclosure.  Service Providers are prohibited from using Personal and Business Information, Usage Data and Business Data other than as specified by us.

TRANSFERS OF PERSONAL AND BUSINESS INFORMATION, USAGE DATA AND BUSINESS DATA

We may share Personal and Business Information, Usage Data and Business Data with businesses controlling, controlled by, or under common control with ARC.  If ARC is merged, acquired, or sold, or in the event of a transfer of some or all of our assets, we may disclose or transfer Personal and Business Information, Usage Data and Business Data in connection with such a transaction.  You will have the opportunity to opt out of any such transfer if, in our sole discretion, it will result in the handling of your Personal and Business Information, Usage Data and Business Data in a way that differs materially from this Privacy Policy.

COMPLIANCE WITH LAWS AND LAW ENFORCEMENT

We cooperate with government, law enforcement officials and private parties to enforce and comply with the law.  We may disclose Personal and Business Information, Usage Data, Business Data and any other information about you to government, law enforcement officials or private parties if, in our sole discretion, we believe it is necessary or appropriate in order to respond to legal requests (including court orders and subpoenas), to protect the safety, property, or rights of ARC or of any third party, to prevent or stop any illegal, unethical, or legally actionable activity, or to comply with the law.

BE CAREFUL WHEN YOU SHARE INFORMATION WITH OTHERS

Please be aware that whenever you share information in communications with third parties or in public areas, that information may be passed along or made public by others.  This means that anyone with access to such information can potentially use it for any purpose, including sending unsolicited communications.

We maintain physical, electronic, and procedural safeguards to protect the confidentiality and security of information transmitted to us, including Personal and Business Information, Usage Data and Business Data.   However, no data transmission over the Internet or other network can be guaranteed to be 100% secure. As a result, while we strive to protect information transmitted on or through the Web Site or our Products and Services, we cannot and do not guarantee the security of any information you transmit on or through the Web Site or our Products and Services, and you do so at your own risk.

LINKS TO THIRD PARTY WEB SITE

Our Web Site and our Products and Services may contain links to other websites or allow others to send you such links.  A link to a third party’s website does not mean that we endorse it or that we are affiliated with it. We do not exercise control over third-party websites.  You access such third-party websites or content at your own risk. You should always read the privacy policy of a third-party website before providing any information to the website.

PROCESSING IN THE UNITED STATES

Please be aware that your Personal and Business Information and communications may be transferred to and maintained on servers or databases located outside your state, province, or country.  If you are located outside of the United States, please be advised that we process and store information in the United States. The laws in the United States may not be as protective of your privacy as those in your location.  By using the Web Site or our Products and Services, you agree that the collection, use, transfer, and disclosure of your Personal and Business Information, Usage Data, Business Data and communications will be governed by the applicable laws in the United States.

CCPA RIGHTS
Residents of California have the following rights under the California Consumer Privacy Act (CCPA) related to data collected in the past twelve months.  
  1.  We may collect the following categories of information as reasonably necessary to provide our products and services to you and comply with your marketing preferences.
    1. Identifiers:  name, email, username, I.P. address
    2. Customer Records Information: phone number, mailing address, occupation
    3. Commercial Information: your purchase history from us
    4. Internet or other electronic network activity information: cookies, browsing history on our sites
    5. Audio, electronic, visual, thermal, olfactory or similar information: your photo and written words in testimonials
    6. Inferences: marketing preferences as indicated by you
  2. In the past 12 months, We have not sold any categories of information.
  3. Under the CCPA you have the following rights:

    i) request disclosure of the categories and specific pieces of your personal information collected.

    ii) request deletion of your personal information that has been collected (with exceptions).

    iii) request disclosure of the categories of personal information collected; the categories of sources from which the personal information is collected; the business or commercial purpose for collecting or selling personal information; the categories of third parties with whom the personal information is disclosed; and the specific pieces of personal information collected;

    iv) request disclosure of the categories of your personal information sold and the categories of third parties to whom your personal information was sold, by category or categories of personal information for each third party to whom your personal information was sold; and the categories of your personal information disclosed for a business purpose;

    v) opt-out of the sale of your personal information; and,

    vi) nondiscrimination should you exercise your rights under the CCPA.

GDPR RIGHTS

If you are within the European Union, you are entitled to certain data protection rights.  Company takes reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Data.  If you wish to know what Personal Data we hold about you and if you want it to be removed from our systems, please contact us.

In certain circumstances, you have the following data protection rights:

i) The right to access, update or to delete the information we have on you. Whenever made possible, you can access, update or request deletion of your Personal Data directly within your account settings section. If you are unable to perform these actions yourself, please contact us to assist you.

ii) The right of rectification. You have the right to have your information rectified if that information is inaccurate or incomplete.

iii) The right to object. You have the right to object to our processing of your Personal Data.

iv) The right of restriction. You have the right to request that we restrict the processing of your personal information.

v) The right to data portability. You have the right to be provided with a copy of the information we have on you in a structured, machine-readable and commonly used format.

vi) The right to withdraw consent. You also have the right to withdraw your consent at any time where Company relied on your consent to process your personal information.

We may ask you to verify your identity before responding to such requests.

 

We require only the information that is reasonably required to enter into a contract with you. We will not require you to provide consent for any unnecessary processing as a condition of entering into a contract with us.

 

PRIVACY POLICY CHANGES

We may change this Privacy Policy from time to time in our sole discretion.  If we decide to change this Privacy Policy, we will inform you by posting the revised Privacy Policy on the Web Site.  Those changes will go into effect on the “Revised Date” shown in the revised Privacy Policy. By continuing to use the Web Site or our Products and Services, you are consenting to the revised Privacy Policy.
